Australian Business Innovation and Investment visa (188)

If you are planning to invest and carry out business in Australia, be that extension or new setup, you can choose this visa. This is a provisional visa that leads to permanent visa application after a 4-8 years.

To be eligible for this program, one must have the capacity to earn a salary over the High Income Threshold or hold a high-grade recent Masters or PhD degree within the following sectors

Common eligibility criteria

    • Be under the age of 55(innovation, investor and entrepreneur streams)
    • Have English proficiency level “Functional” (all streams except entrepreneur stream)
    • Have English proficiency level “Competent” (only entrepreneur stream)
    • Score a minimum of 65 points. Points depend on age, English language proficiency, education, business size and growth and your experience with business.Points test applies to innovation and investor streams.
    • Be Nominated by Australian Territory government agency, or State or Austrade
    • Be invited by Department of Home Affairs to apply for the visa the state has nominated you for.
    • Meet health and character requirements stipulated by DHA
    • No debt to Australian Government
    • No previous record of Australian Visa cancellation

     

    There are 7 streams of this visa which are designed for different cases and situations. There streams are described below:

Business Innovation Stream

This visa works well for those who have entrepreneur skills. It allows you to run a new or existing business in the Australian region. With this visa, you can own and run a business in Australia, conduct business operations and investment in Australia or emerge as a successful entrepreneur. You have to provide proof of your legitimate business success (ownership stake, annual turnover) You, your partner, or you both must have total net business worth and personal assets of at least AUD 800,000. You’ll be required to transfer funds to Australian within 2 years after getting the visa. You’ll need functional English (4.5 in each band of IELTS) and at least 65 points to be able to apply for the visa.

Stay Period: You can stay for a period of up to 4 years and 3 months

Cost: The cost starts at AUD5,375

Investor Stream

This is a provisional visa stream that requires you to invest a minimum of AUD 1.5 million in an Australian Territory or State and maintain your investment or business activities in Australia. You, your partner or your and your partner together must have a business, investment and assets ofnet worth of at least AUD 2.25 million. You must have a minimum 3 years’ work experience of managing a qualifying business or investment. You’ll need functional English (4.5 in each band of IELTS) and at least 65 points to be able to apply for the visa.

Stay Period: The stay period for this visa stream is for up to 4 years and 3 months

Cost: starts from AUD5,375 and it increases if additional applicants are included.

Significant Investor Stream

This provisional visa stream suits those who intend to invest a minimum of AUD5 million in the Australian State or Territory. You have to maintain the investment for at least 4 years. You can invest in growth private equity funds, venture capital or approved managed funds. This is not a points-tested visa stream and there is not age restriction, however you’ll need functional English.

Stay Period: The stay period for the Significant Investor stream visa is up to 4 years and 3 months.

Cost: Visa processing cost starts from AUD7,880

Business Innovation Extension Stream

  • This visa allows the Innovation Stream Visas holder (subclass 188) to extend the visa 2 more years. They can stay in Australia for 6 years after the grant of the original subclass 188 Innovation stream that was held at the time of application.

    Cost: The visa fee starts from AU$645

    You Must:

     

    • Have held a Business Innovation Stream visa under the subclass 188 for a minimum of three years.
    • Not have held more than 1 Business Innovation and Investment visa (subclass 188)

Significant Investor Extension Stream

  • The significant investor extension stream visa allows the holder of subclass 188 Significant Investor Stream to extend their stay in Australia for up to 4 years and to carry out business activities.

    Cost: The visa processing cost starts from AUD645.

    You Must:

     

    • Have held Significant Investor Stream visa for at least 3 years.
    • Not have held more than one Significant Investor Stream visa.
